Important Notice
These terms constitute a legally binding agreement. By booking and staying at any Blu Luxury Rentals property in Cape Coral, Fort Myers, or Southwest Florida, you acknowledge that you have read, understood, and agree to be bound by all provisions herein.
1. Booking Agreement & Guest Registration
By booking a stay at any Blu Luxury Rentals property in Cape Coral, Fort Myers, or Southwest Florida, you agree to abide by all house rules, payment terms, cancellation policies, and local ordinances. The person making the reservation must be at least 25 years old and will be held responsible for all guests and their actions.
Guest Registration Requirements:
- All guests must be listed at time of booking with full names and ages
- Unregistered guests are strictly prohibited without written consent
- Maximum occupancy limits are strictly enforced and cannot be exceeded
- Valid government-issued photo ID required for all guests 18 and older
- Primary renter must be present during the entire stay
- No subletting, assignment, or third-party bookings allowed
2. Payment Terms & Security Deposits
Full payment is required at time of booking unless otherwise specified. A security deposit will be charged separately and may be increased based on guest count, length of stay, or property value.
Security Deposit Terms:
- Security deposits range from $500-$2000 depending on property
- Deposits are charged 48 hours before check-in
- Refunds processed within 7-14 business days after departure
- Additional charges may exceed the security deposit amount
- Payment disputes must be raised within 30 days
3. Liability Waiver & Assumption of Risk
Guests agree to use the property, amenities, and outdoor spaces entirely at their own risk. Blu Luxury Rentals, property owners, and their agents are not responsible for accidents, injuries, death, illness, or loss of personal belongings during your stay in Cape Coral, Fort Myers, or Southwest Florida.
Specific Risk Acknowledgments:
- Swimming pools, spas, and water features (drowning risk)
- Outdoor amenities including fire pits, grills, and furniture
- Stairs, balconies, decks, and elevated areas
- Kitchen appliances and electrical equipment
- Wildlife, insects, and environmental hazards in Southwest Florida
- Slip and fall hazards on all surfaces
- Pre-existing medical conditions that may be aggravated
Children must be supervised at all times. Guests with children assume full responsibility for their safety and behavior.
4. Property Rules & Restrictions
Strictly Prohibited:
- Smoking of any kind (including e-cigarettes, vaping) - $500 minimum fine
- Pets without written approval - $300 fine plus cleaning fees
- Parties, events, or gatherings exceeding occupancy limits
- Illegal activities of any kind
- Moving furniture or removing property items
- Using pools/spas outside designated hours (10 PM - 8 AM)
- Bringing glass containers near pool areas
- Tampering with security cameras or safety equipment
Required Conduct:
- Maintain cleanliness and order throughout stay
- Report damages or issues immediately
- Properly dispose of trash and recyclables
- Secure property when leaving
- Follow all posted safety guidelines
- Respect Cape Coral and Fort Myers community standards
5. Damages, Charges & Penalties
Guests are financially responsible for any and all damages, excessive cleaning, or policy violations during their stay at our Cape Coral, Fort Myers, or Southwest Florida properties. Charges will be assessed at full replacement value plus labor costs.
Standard Penalty Fees:
- Smoking violation: $500 minimum + deep cleaning ($200-800)
- Unauthorized pets: $300 + cleaning and damage costs
- Excessive cleaning: $75-200 per hour
- Missing or damaged items: Full replacement cost + 25% handling fee
- Late checkout (without approval): $100 per hour
- Noise violations: $200 per incident
- Unauthorized guests: $100 per person per night
- Pool/spa misuse: $300 + repair costs
Charges may exceed the security deposit. Additional payment is due within 15 days of billing.
6. Cancellation & Refund Policy
Cancellation policies vary by property and season. Strict cancellation policies apply during peak seasons and holidays in Southwest Florida.
Standard Cancellation Terms:
- Cancellations 60+ days: Full refund minus processing fees
- Cancellations 30-59 days: 50% refund
- Cancellations 14-29 days: 25% refund
- Cancellations under 14 days: No refund
- No-shows: No refund, full charges apply
- Early departures: No refund for unused nights
Weather-related cancellations must be accompanied by official evacuation orders to qualify for refunds.
7. Noise Ordinances & Community Respect
Quiet hours are strictly enforced from 10:00 PM to 8:00 AM in all Cape Coral and Fort Myers neighborhoods. Excessive noise at any time may result in immediate termination without refund.
Noise Policy Details:
- Respect all neighbors and community standards
- No loud music, parties, or disruptive behavior
- Pool and outdoor activities must end by 10 PM
- One noise complaint may result in immediate eviction
- Police involvement will result in automatic eviction and no refund
- Additional security deposit may be required for large groups
8. Security & Monitoring
Properties may be equipped with exterior security cameras and noise monitoring devices for safety and compliance purposes.
Monitoring Disclosure:
- Exterior cameras monitor entrances, pools, and common areas
- No cameras in bedrooms, bathrooms, or interior private spaces
- Noise monitoring devices track decibel levels only
- Tampering with security equipment is strictly prohibited
- Recorded evidence may be used for rule enforcement
9. Insurance Requirements
Travel insurance is mandatory for all bookings to protect against unforeseen circumstances, cancellations, or emergencies during your Southwest Florida vacation.
Insurance Coverage Must Include:
- Trip cancellation and interruption coverage
- Medical emergency coverage
- Baggage and personal effects protection
- Liability coverage for accidental damage
- Weather-related coverage when applicable (hurricanes, storms)
Proof of coverage may be requested. Failure to maintain insurance may void certain protections.
10. Indemnification & Hold Harmless
Guests agree to indemnify, defend, and hold harmless Blu Luxury Rentals, property owners, and their agents from any and all claims, damages, losses, costs, and expenses arising from guest use of Cape Coral, Fort Myers, or Southwest Florida properties.
Indemnification Includes:
- Personal injury or death of any guest or visitor
- Property damage caused by guests or their invitees
- Legal fees and court costs related to guest actions
- Third-party claims arising from guest activities
- Violations of local laws or ordinances
- Environmental damage or contamination
11. Jurisdiction & Dispute Resolution
This agreement is governed by Florida state law. All disputes will be resolved in Lee County, Florida courts. Guests consent to personal jurisdiction in Florida.
Dispute Resolution Process:
- Attempt good faith negotiation for 30 days
- Binding arbitration if negotiation fails
- Arbitration conducted under Florida Arbitration Code
- Prevailing party entitled to attorney fees and costs
- No class action lawsuits permitted
12. Force Majeure & Emergencies
Blu Luxury Rentals is not liable for circumstances beyond reasonable control including natural disasters, government actions, pandemics, or other force majeure events affecting Southwest Florida travel.
Force Majeure Events Include:
- Hurricanes, floods, earthquakes, or severe weather in Southwest Florida
- Government-ordered evacuations or lockdowns
- Utility failures or infrastructure problems
- Pandemic-related restrictions or closures
- Acts of terrorism or civil unrest
- Property damage requiring immediate repairs
Alternative accommodations or rescheduling will be offered when possible, but monetary compensation may be limited to amounts recoverable through travel insurance.
